The FBI is investigating the Clinton Foundation because it is a criminal enterprise. Only six percent (6%) of donations to the Clintons' charity goes to charity, the remaining goes to fund the lifestyles of Bill, Hillary, Chelsea and their various aides - Huma Abedin, Sid Blumenthal, etc.
For four years, those donations also bought prime access to the U.S. Secretary of State. That is why Hillary and her acolytes, Huma Abedin, Cheryl Mills, and the other supposed "government employees," used a private email server contrary to extant law. 18 U.S. Code § 793(f) holds that anyone who exposes national-defense information to an unsecured environment “through gross negligence” is guilty of a felony. It is improper to argue that Hillary did not violate this law, which does not make allowances for intent. Even if Hillary did not mean to send or receive classified information on an unsecured server, she still did so, and is still by all appearances guilty of the gross negligence that the law specifies. She has not been “cleared” or “exonerated” of criminal misconduct; she has been implicated in such misconduct. Essentially, she is not indicted due to politics. James Comey’s decision not to prosecute her was outside the responsibilities of the FBI.
Comey, the FBI director, is the head of the nation's prime law enforcement agency, not a Justice Department prosecutor, much less the attorney general. The FBI is not supposed to decide whether the subject of a criminal investigation gets indicted. It placed law enforcement in the service of politics. Hillary should have condemned it, but she turned it into an exoneration, which it was not. She had no right to know in July 2016 whether the investigation was closed. She also had no right to know in October 2016 whether the investigation was reopened. Like any other criminal suspect, she should simply wait.
